1. Acceptance of Terms
By creating an account or using Lumideo ("the Service"), you agree to these Terms of Service and our Privacy Policy. These Terms form a binding legal agreement between you and Proapptiva S.R.L.S ("we", "us", "our"), an Italian limited liability company. If you do not agree, do not access or use the Service. Effective date: June 1, 2026. We may update these Terms at any time. Material changes will be notified via email or in-app notification. Continued use after the effective date constitutes acceptance.
2. Eligibility and Account
You must be at least 13 years old (or the minimum age required by law in your country) to use the Service. By registering, you confirm that all information you provide is accurate and that you will keep your account credentials confidential. You are responsible for all activity that occurs under your account. You may not create more than one account or transfer your account to another person.
3. Description of Service
Lumideo is a video capsule application that allows users to record, store, and deliver video messages ("capsules") to themselves or to other users at a future date chosen at the time of creation. Capsules may not be accessed before their designated unlock date. We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service.
4. User Content
You retain full ownership of all video content and messages you record and submit through the Service ("User Content"). By uploading User Content, you grant Proapptiva S.R.L.S a limited, non-exclusive, royalty-free, worldwide license to store, transmit, and deliver that content solely for the purpose of providing the Service. We do not review the contents of your capsules and will not access them except as required by law or to investigate a credible violation report. You represent and warrant that: (a) you own or have the right to submit the User Content; (b) the User Content does not infringe any third-party intellectual property right or applicable law; (c) the User Content does not contain unlawful, obscene, defamatory, threatening, or harassing material.
5. Prohibited Conduct
You agree not to: • Use the Service for any unlawful purpose or in violation of any applicable law • Upload or transmit content that is illegal, harmful, threatening, abusive, harassing, defamatory, or invasive of another's privacy • Impersonate any person or entity or falsely state your affiliation • Attempt to gain unauthorized access to any portion of the Service or its related systems • Reverse engineer, decompile, or disassemble any part of the Service • Use automated means (bots, scrapers) to access the Service or create accounts • Transmit any viruses, malware, or other harmful code • Interfere with or disrupt the integrity or performance of the Service
6. Capsule Delivery and Reliability
While we make every reasonable effort to deliver capsules on their designated unlock dates, we cannot guarantee uninterrupted availability of the Service. Capsule delivery is contingent on: (a) the recipient maintaining an active Lumideo account; (b) the continued availability of third-party infrastructure services we rely on (including Google Firebase and Google Cloud Platform); and (c) your account remaining in good standing. We are not responsible for failed or delayed delivery caused by factors outside our reasonable control, including infrastructure outages or the recipient having deleted their account.
7. Data Storage and Third-Party Services
Video capsules are stored on Google Cloud Storage via Firebase, operated by Google LLC. User account data, capsule metadata, and scheduling information are stored in Google Firestore. Authentication is provided by Firebase Authentication (Google LLC). We use Sentry (Functional Software, Inc.) for error monitoring. Sentry may receive anonymized technical data about app errors. Sentry does not receive User Content. We use Firebase Analytics (Google LLC) for anonymized usage analytics. Push notifications are delivered via Apple Push Notification Service (APNS) and Firebase Cloud Messaging (FCM).
8. Intellectual Property
The Lumideo application, its design, code, trademarks, and logos are the exclusive property of Proapptiva S.R.L.S and are protected by applicable intellectual property laws. Nothing in these Terms grants you any right or interest in the Service beyond the limited right to use it as described herein.
9. Account Termination and Data Deletion
You may delete your account at any time from the app settings. Upon account deletion, all your capsules and personal data will be permanently deleted from our servers within 30 days, except where retention is required by applicable law. We may suspend or terminate your account immediately if you violate these Terms or engage in fraudulent activity. Upon termination, your right to use the Service ceases immediately.
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PROAPPTIVA S.R.L.S DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PROAPPTIVA S.R.L.S WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR REVENUE ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS SHALL NOT EXCEED THE GREATER OF EUR 50 OR THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.
12. Governing Law and Disputes
These Terms are governed by the laws of Italy. Any dispute shall be subject to the exclusive jurisdiction of the courts of Benevento, Italy. If you are an EU consumer, you may have the right to submit a complaint to your local consumer protection authority or use the EU Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
